Terms of Sales
These general conditions refer to French law and, more particularly, to the regulation of distance selling. They govern the contractual relations between the site www.amazing-grace-art.com represented by ORLA DEVY and its client (the buyer).
Accepting an order on the site implies the customer’s full and unreserved acceptance of these general conditions of sale.
Any order form signed by the customer by the “validation click” constitutes irrevocable acceptance by the customer. Orders are binding on Orla Devy “Amazing Grace Art” only after validation of payment and acceptance of the order by the person in charge of the site www.amazing-grace-art.com. The contract is concluded only upon confirmation of the order sent by email from our site.
The content of the order is that specified in this order form sent by email.
The work, as well as the dispatch and delivery times, will begin upon receipt of the full amount of the order, unless otherwise stated expressly posted on the site (closing of the store due to holidays, etc.).
Order cancellation: to cancel the order before it is sent, the customer just has to connect to the site, use the “contact” tab and signify the cancellation. He can also send an email to firstname.lastname@example.org specifying the order number on the order form.
The seller reserves the right to cancel any order placed by a customer for whom there is a previous payment dispute.
The prices indicated are in euros and are net (VAT not applicable, article 293 bis of the CGI.) The amount invoiced for each order includes the price of materials and labor.
Prices are subject to change without notice.
Invoices are established in accordance with the prices in effect at the time of the order; these same prices will also have been accepted in advance by the customer at the confirmation of his order.
Payment is made when ordering:

• By credit card online by Stripe®
• Or by check payable to “Orla Devy”, sent to Orla Devy, 1 cité des cadres, Ty Vougeret, 29150 DINEAULT
By these payment terms, there are no late payment penalties.
Pursuant to Law 80-335 of May 12, 1980, the items ordered will remain the property of Orla Devy “Amazing Grace Art” until full payment.
Delivery costs are payable and progressive according to the total price of the order.
Delivery is made by post by Colissimo or by Letter Tracking, at the customer’s choice when ordering. The shipment of the ordered items is done within a maximum of 72 working hours to the address provided by the customer. It is the customer’s responsibility to verify the accuracy of the delivery address. An email is sent to the customer to inform them of the shipment of their order and a shipment tracking number is communicated to them at that time.
Delivery times depend on the network and the operation of the Post Office and Orla Devy “Amazing Grace Art” is in no way responsible. Thus, any delays do not entitle the customer to claim damages.
In all cases, the product (s) travel (s) at the risk and peril of the buyer to whom it belongs, in the event of damage or missing, to make any necessary findings and to confirm their reservations by deed. extrajudicial or by registered letter with acknowledgment of receipt from the carrier within two days of receipt of the goods.
The goods are deliverable outside French territory. Note that all taxes and formalities generated will be fully supported by the customer.
It is up to each customer not to order products that may be prohibited for import into their country. If this were the case, Orla Devy “Amazing Grace Art” could not be held responsible for the rejection of the delivery by the destination authorities.
6. Withdrawal, return and exchange
In the context of distance selling (without the simultaneous physical presence of the parties), according to the consumer code and article L222-7, the consumer has a period of fourteen days to exercise his right of withdrawal, without having to justify the reason or to bear penalties with the exception of the return costs which remain at his expense. Shipping charges are not refundable. If the buyer receives a refund, the return costs will be deducted from their refund.
The period during which the right of withdrawal may be exercised runs from receipt of the order. The period begins to run at the beginning of the first hour of the first day and ends at the expiration of the last hour of the last day of the period. If this period expires on a Saturday, a Sunday or a public holiday, it is extended until the next working day.
The buyer can therefore return the item, undamaged and unused, in its original packaging, the return costs being his responsibility. Returns must be made to the following address: Orla Devy, 1 cité des cadres, Ty Vougeret, 29150 DINEAULT
Once the return is received and inspected, Amazing Grace Art will send an email to notify the customer of receipt of the returned item. They will also notify you of the approval or rejection of the refund. The item will then be reimbursed by check within 2 weeks.
If an exchange has been requested, the time limit for sending the replacement product will not exceed 2 weeks. The value of the exchanged product will be limited to that of the initial product on the date of its sale.
Only regular priced, non-personalized items can be refunded. Sale items cannot be refunded.
Warning in the event of a personalized order: According to article L 121-20-2 of the Consumer Code, the right of withdrawal provided for in the event of distance selling cannot be exercised (unless the parties have agreed otherwise after exchange of messages by email) for contracts for the supply of goods made to the consumer’s specifications or clearly personalized or which, due to their nature, cannot be reshipped.
The customer’s attention is therefore drawn to the fact that the right of withdrawal does not apply to sales of personalized products at his request except in the event of a major defect in the support.
The products sold benefit from the legal guarantee against hidden defects provided for by articles 1641 and following of the civil code.
The photographs of the products may be slightly different from the products actually received when ordering, because the product may have been out of stock and remade at the customer’s request. Thus, each creation being artistically executed as a unique piece, it cannot be exchanged or refunded under the pretext of a visual or dimensional non-conformity. Regarding the dimensions, a variation tolerance should be accepted as such. The dimensions announced on the site are indicative. A variation of a few millimeters can be noticed. As with the colors, the photos are corrected to best reflect the actual colors but they may nevertheless contain minimal differences in color from the reality. The buyer agrees to accept these differences in tones.
8. Computer problem
The customer knows the characteristics of the internet computer network and in particular the possibility of connection interruption, breakdown, electrical or other problems. The seller cannot be held responsible.
In the event of a dispute, the customer will send a request via the contact form to Orla Devy on the site www.amazing-grace-art.com or to email@example.com to obtain an amicable solution.
The seller’s liability is limited to the repair or replacement of the product. Its value will be limited to that of the product on the date of its sale.
10. Computing and Freedom
The provision of personal information collected for the purposes of distance selling is mandatory, this information being essential for the processing and delivery of orders and the preparation of invoices. The lack of information results in the non-validation of the order.
In accordance with the law n ° 78-17 of January 6, 1978 modified on August 7, 2004 relating to data processing, files and freedoms and n ° 2004-575 of June 21, 2004 for confidence in the digital economy, any person has the right to access, modify, rectify and delete data concerning him by sending an email to firstname.lastname@example.org.
